Chair Jerry Hill called the meeting to order at 9:05 a.m.

GENERAL COUNSEL PROPOSAL
  1. CONFERENCE WITH LEGAL COUNSEL - PENDING LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9(A) ROBERT E. ELLIS V SAN MATEO COUNTY TRANSIT DISTRICT ET AL

    Legal Counsel David Miller said the purpose of the closed session was to discuss pending litigation of the Ellis V. SamTrans case.


  2. CONFERENCE WITH LABOR NEGOTIATOR -PURSUANT TO GOVERNMENT CODE SECTION 54957.6, AMALGAMATED TRANSIT UNION, LOCAL 1574

    Legal Counsel David Miller said the purpose of the closed session was to hear a brief report from Legal Counsel Doug Burton and Monica Colondres, Director of Human Resources on the status and progress of the labor negotiations with ATU Local 1574.

THE BOARD ADJOURNED INTO CLOSED SESSION AT 9:10 A.M. AND RECONVENED TO OPEN SESSION AT 9:45 A.M.

Mr. Miller said the Board of Directors met in closed session as permitted by the Brown Act to discuss the above referenced items.

He said specifics of the on-going negotiations with ATU Local 1574 will be reported on or before the next SamTrans Board meeting. A resolution for the approval of a collective bargaining agreement with ATU Local 1574 was unanimously approved and Resolution 2005-33 was adopted.

DECLARING THE UNCERTAINTY OF COMPENSATION OF DISTRICT ADMINISTRATIVE EMPLOYEES AS OF JULY 1, 2005
Mr. Miller said a resolution to declare the uncertainty of compensation of District administrative employees was before the Board members for adoption in anticipation of the General Manager/CEO presenting a compensation recommendation at the July SamTrans Board meeting effective July 1, 2005.

The motion to approve the declaration of the uncertainty of compensation of District administrative employees was unanimously approved by roll call and Resolution 2005-34 was adopted.
